Terms of Service

1. Definitions

“Site” means this website, including any subdomains, pages, features, APIs, tools, chat/AI interfaces, forms, upload portals, and content made available through it.

“Operator” means Tina Browning Realty (brand) and the licensed real estate professionals operating the Site in affiliation with Green Tree Real Estate Services (“Brokerage”), unless expressly stated otherwise.

“User” means any person or entity that accesses or uses the Site.

“Content” means all text, graphics, images, videos, software, code, and data made available through the Site.

“Submission” means any information a User submits to the Site, including contact requests, inquiries, telephone numbers, email addresses, property addresses, chat/AI inputs, uploaded files, and any other materials transmitted via the Site.

“AI Features” means any automated or machine-assisted interface used to collect information, route inquiries, provide general information, or assist lead intake.

“MLS Data” means real estate listing data or related property information provided by a multiple listing service (MLS), IDX, VOW, or another third-party data provider.

2. Acceptance; Incorporation by Reference; Modifications

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Site.

We may modify these Terms at any time by posting an updated version to the Site. Changes are effective upon posting. Continued use constitutes acceptance.

3. Eligibility; Authority

You must be at least 18 years old (or the age of majority where you reside) to use the Site. If you use the Site on behalf of an entity, you represent you have authority to bind that entity.

4. Licenses; Jurisdictional Limitations

Affiliated with Green Tree Real Estate Services.

The Site is made available for informational purposes and lead intake. The Operator does not offer to provide, and does not provide, real estate brokerage services in jurisdictions where doing so would violate licensure or other legal requirements. Users seeking relocation assistance from outside Indiana or Kentucky acknowledge that any brokerage services in another jurisdiction (if any) may require referral to and/or cooperation with a properly licensed broker/agent in that jurisdiction, subject to separate written agreements.

5. No Agency; No Client Relationship; No Reliance

Use of the Site and/or submitting a request does not create an agency relationship, fiduciary duty, attorney-client relationship, or any other client relationship. No duties of representation are created unless and until the parties execute a separate written agreement that expressly creates such relationship.

Information on the Site is provided for general informational purposes only and may be incomplete, outdated, or inaccurate. Users must independently verify information and obtain professional advice appropriate to their circumstances.

6. AI Features; Automated Lead Intake

6.1 General

The Site may use AI Features to (a) collect lead information (including phone numbers and addresses), (b) categorize or route inquiries, (c) provide general informational responses, and/or (d) assist in scheduling and follow-up. AI Features may generate outputs that are probabilistic and may be incorrect or incomplete. AI outputs are not professional advice and are not guarantees of outcomes.

6.2 User Responsibility for Inputs

You are solely responsible for the accuracy and legality of your inputs. You agree not to input or upload information you do not have the right to provide.

6.3 No Sensitive Uploads

Do not submit sensitive personal information unless the Site explicitly requests it for a specific transaction, including (without limitation) Social Security numbers, driver’s license numbers, financial account numbers, health information, or other information subject to heightened legal protections. If you submit such information anyway, you do so at your own risk, and you authorize the Operator to delete it.

6.4 Address Data

If you submit a property address, you represent you have the right to disclose it. Address-based outputs (valuation ranges, neighborhood summaries, flood commentary, school notes, etc.) are informational estimates only and require independent verification.

7. Communications Consent (Calls, Texts, Email)

7.1 Consent

By providing your telephone number(s) to the Site (including through AI Features) you authorize the Operator and/or Brokerage to contact you at that number by call or text (SMS/MMS) for purposes related to your inquiry, services, scheduling, and customer support.

7.2 Telemarketing Compliance

Where required by law for advertising or telemarketing calls/texts using automated dialing or prerecorded/artificial voice, the Operator will obtain the legally required consent. You understand: (a) your consent is not a condition of purchase, (b) message/data rates may apply, and (c) you may revoke consent through any reasonable means. Communications are subject to applicable TCPA/FCC rules, including 47 C.F.R. § 64.1200.

7.3 Opt-Out

You may opt out of text messages by replying STOP (or any equivalent command identified in the message). You may opt out of marketing emails using the unsubscribe mechanism provided. CAN-SPAM requires (among other things) a functional opt-out and a valid physical address in commercial email.

8. Uploaded Files; Electronic Records; E-Sign

8.1 Upload Feature

The Site may permit you to upload documents you complete (e.g., disclosures, questionnaires, intake forms, or related materials). You represent you have all rights necessary to upload and share those files and that they do not violate law or third-party rights.

8.2 Prohibited Uploads

You agree not to upload files that:

• Contain malware or malicious code
• Infringe intellectual property rights
• Include unlawful discriminatory content
• Include sensitive personal information unless explicitly requested
• Contain confidential information you are not authorized to disclose

8.3 Security and Processing

Uploaded files may be scanned, processed, converted, stored, and transmitted to support your request and the Site’s operation. The Operator does not guarantee that uploads will be free from loss, corruption, or unauthorized access.

8.4 Electronic Records and Signatures

To the extent the Site enables electronic records and/or electronic signatures for transactions with consumers, the Operator will obtain any required consumer consent and provide required disclosures consistent with the E-SIGN Act (including affirmative consent, disclosures about paper copies/withdrawal, and retention/access requirements).

8.5 Retention/Deletion

Unless otherwise required by law or recordkeeping obligations, the Operator may delete uploads after a reasonable period. Users are responsible for maintaining their own copies.

9. Submissions; Limited License

You grant the Operator a non-exclusive, worldwide, royalty-free license to use, store, process, transmit, reproduce, and display your Submissions solely as necessary to: (a) respond to you; (b) provide requested services/information; (c) operate, secure, and improve the Site and AI Features; (d) comply with legal obligations; and (e) maintain business records and resolve disputes.

This license does not authorize publication of private inquiry content as marketing/testimonials without your consent.

10. MLS / IDX / Third-Party Listing Data

If the Site displays MLS Data, such data is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than identifying prospective properties consumers may be interested in purchasing. MLS Data is deemed reliable but is not guaranteed accurate and must be independently verified.

11. Intellectual Property; Site License

The Site and Content are owned by the Operator, Brokerage, or licensors and protected by intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes, subject to these Terms. You may not scrape, crawl, data-mine, reverse engineer, or exploit the Site except as permitted by law or written authorization.

12. DMCA / Copyright Complaints

Include: your contact info, identification of the work claimed infringed, identification of the material, a statement of good-faith belief, a statement under penalty of perjury, and your signature.

13. Third-Party Links; Tools; Integrations

The Site may integrate third-party tools (maps, analytics, messaging, scheduling, AI providers) and link to third-party websites. The Operator is not responsible for third-party content, availability, or practices. Use at your own risk.

14. Fair Housing / Nondiscrimination

The Operator supports applicable fair housing and nondiscrimination laws. The Operator may remove content or refuse service communications that request or promote unlawful discrimination or steering.

15. Disclaimer of Warranties

THE SITE, AI FEATURES, CONTENT, AND ANY MLS DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE OPERATOR DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE OR THAT CONTENT/AI OUTPUTS WILL BE ACCURATE, COMPLETE, OR CURRENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE OPERATOR OR THE BROKERAGE (OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS) BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT PAID BY YOU (IF ANY) FOR USE OF THE SITE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some limitations may not apply.

17. Indemnification

You agree to indemnify, defend, and hold harmless the Operator and Brokerage (and their affiliates, officers, directors, employees, and agents) from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Site; (b) your breach of these Terms; (c) your Submissions/uploads; or (d) your violation of law or third-party rights.

18. Governing Law; Venue; Severability

These Terms are governed by Indiana law, excluding conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Clark County, Indiana, and you consent to jurisdiction and venue there.

If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

19. Termination; Survival

The Operator may terminate or suspend access at any time. Provisions that by their nature should survive (including intellectual property, DMCA, disclaimers, limitation of liability, indemnity, dispute resolution) survive termination.
