Exclusive Buyer Agency Agreement

This is a legally binding agreement between the Buyer/Client identified above and the Agent/Licensee, Tina Browning, of Green Tree Real Estate Services. By signing this agreement, Buyer/Client agrees to work exclusively with the Agent during the term of this agreement.

Agent Responsibilities

  1. Perform the terms of the brokerage agreement made with the Buyer/Client
  2. Promote the best interests of the Buyer/Client
  3. Timely account for all money and property received
  4. Timely present each written offer and acceptance to the Buyer/Client
  5. Disclose all material facts known by the Agent concerning the transaction
  6. Advise the Buyer/Client to obtain expert advice on material matters beyond the Agent’s expertise
  7. Maintain confidential information of the Buyer/Client

Buyer/Client Responsibilities

  1. Work exclusively with the Agent during the term of this agreement
  2. Timely provide accurate financial and personal information as needed
  3. Promptly review and respond to all documents and communications
  4. Be available for property showings and inspections
  5. Not negotiate directly with sellers or their agents
  6. Disclose any known material facts about their ability to complete a purchase
  7. Pay agreed-upon compensation as outlined in this agreement

Compensation

Buyer/Client agrees to pay the compensation specified above. If compensation is offered by the seller or listing broker, this may satisfy all or part of the Buyer/Client’s obligation. Any difference remains the responsibility of the Buyer/Client.

Dispute Resolution

Any dispute arising from this agreement shall first be addressed through mediation before any legal action is initiated. Both parties agree to participate in good faith.

Hold Harmless

Buyer/Client agrees to hold harmless the Agent and Green Tree Real Estate Services from any claims, damages, or expenses arising from information provided by third parties, including but not limited to sellers, inspectors, and appraisers.

Termination

This agreement may be terminated by either party with written notice. Buyer/Client remains obligated for compensation on any property shown or introduced during the term of this agreement if a purchase is completed within the protection period.

Office Policy

Green Tree Real Estate Services charges a $150 administrative/closing fee to the buyer at closing. This fee is in addition to any agreed-upon compensation.

I understand this is an exclusive agreement and I will work only with the Agent during the term.

I understand the termination and protection period terms of this agreement.
I acknowledge the $150 administrative/closing fee charged by Green Tree Real Estate Services.
